California Homeowners' Associations (HOAs) can now take advantage of electronic voting, providing a modern, secure, and efficient way to conduct elections. Under Civil Code Section 5110(c), electronic voting is authorized for HOA elections, offering a streamlined and user-friendly alternative to traditional paper ballots. Preparing for Electronic Voting
To implement electronic voting, HOAs must first update their Election Rules to permit online voting. This change is required by the new electronic voting law. Your HOA’s legal counsel can assist in drafting rules that align with your community's needs, or you can find sample rules available online. Any sample rules should be customized in consultation with your legal advisor to ensure they meet your HOA's specific requirements.
